ACCEPTANCE OF THESE TERMS
By using the App, you accept all of the provisions of these Terms and any Additional Terms (defined below), and represent and warrant that you are at least the age of majority in your jurisdiction (or are sixteen (16) years of age or older and have your parent or guardian’s consent to the Terms) and have the requisite power and authority and all permissions necessary to enter into and be bound by these Terms, and you acknowledge that you have read understood, and agree to be bound by, these Terms, and agree to comply with all applicable laws and regulations in connection with your use of the Lift Up My Heart App.
MEMBERSHIP AND PAYMENT TERMS GENERAL
If one subscribes to the Lift Up My Heart App, you can select the monthly renewable payment plan of ($2.99 per month,) or the single payment annual plan of ($30.00 per year.) DKG Digital Solutions will charge the subscription fee displayed to you and each renewal fee, as applicable, to your desired payment method at the then-prevailing rate.
If one subscribes for the monthly renewing subscription (a “Subscription”), DKG Digital Solutions will charge a subscription fee(s) to the payment method provided at the time of registration. Your Subscription will automatically renew as further set forth below. By submitting one’s payment method information to us, you hereby agree that you authorize us or our third-party payment processors to charge your payment method, as applicable, at our convenience but in any event within thirty (30) days of initial payment authorization and, if you elect to pay a Membership Subscription, thereafter automatically within thirty (30) days after each renewal date or upon such other renewal periods we communicate to you when you first register for a Subscription. Should one’s payment method fail to authorize, you will be notified of such failure via email. The benefits of your Subscription may be suspended until payment is received. If payment is not received within thirty (30) days, your membership may be canceled.
Membership Term and Termination.
Except in the event of our fourteen day, (14) free trial offer, one’s Subscription will commence as of the date your payment is received by DKG Digital Solutions. If you sign up for a Subscription, your Subscription will continue in full force for the length of the term you specifically purchased. In the event that one cancels a Subscription prior to the expiration of your Subscription Term, you will be entitled to receive a refund for the unused portion of the remainder of that Subscription Term.
Auto-Renewal of Membership.
Subscriptions, including those that may be first offered on a free or discounted promotional basis, will automatically renew at the end of your Subscription Term continuously and indefinitely without action by you, and the subscription fee for your subscription is charged to you at the time of renewal unless you cancel your Subscription prior to renewal or your account is suspended or terminated pursuant to this agreement. You acknowledge and agree that your account will be subject to the above-described automatic renewals. If your Subscription fee has been paid, you are entitled to all privileges included in the Subscription until such time that you elect to cancel your Subscription.
A Subscriber will have the right to cancel their Subscription at any time upon notice to DKG Digital Solutions via email, by sending a request to email@example.com. Cancellation of one’s Subscription should be done prior to the end of the then-current Subscription Term. Upon cancellation, the Subscriber will lose access to the functions of the App designated for Subscribers only.
Access To A Subscribers Contacts
The Lift Up My Heart App has available to the subscriber a “group,” function, in which an existing subscriber can send an invitation to individuals within the contact list of their digital device. Through this invitation, non-subscribers, as well as existing subscribers, can be included in closed-looped prayer groups. A non-subscriber, will not have access to the full functionality of the App. They will have limited access to the prayer or prayers selected by the group organizer and the associated reminders.
Additionally, persons within one’s contact list who are current subscribers of the Lift Up My Heart App will be shown to other subscribers as being registered subscribers of the App.
Finally, the Lift Up My Heart App has a “share,” function through which an existing subscriber can share one or more prayers from the internal prayer library with other individuals from their contact list be they current subscribers or non-subscribers.
Generally. All prices displayed are quoted in U.S. dollars. Prior to one’s purchase completion of a Subscription, a valid payment method must be provided and include the following information: (i) your name as it appears on the card, (ii) your credit/debit card number, (iii) the credit/debit card type, (iv) the date of expiration, and (v) any activation numbers or codes needed to charge one’s card.
By submitting that information to DKG Digital Solutions, one is agreeing that one is authorizing DKG Digital Solutions and/or our processor to charge one’s card at our convenience but within thirty (30) days of credit card authorization.
Methods of Payment; Credit Card Terms.
All payments must be made through one’s Visa, MasterCard, Discover, American Express, or such other method(s) specifically identified and accepted via the App from time to time. One’s card issuer agreement governs the use of one’s designated card, and one must refer to that agreement and not these Terms to determine your rights and liabilities as a cardholder.
One represents and warrants that one will not use any credit card or other form of payment unless one has all necessary legal authorization to do so. DKG Digital Solutions, will not be responsible for paying any unauthorized amounts billed to one’s credit card by a third party. One agrees to pay all fees and charges incurred in connection with one’s purchases (including any applicable taxes) at the rates in effect when the charges were incurred.
NOTICES, QUESTIONS AND CUSTOMER SERVICE
One agrees that DKG Digital Solutions; (1) may give one notices of new, revised, or changed terms and other important matters via email, or in another reasonable manner; and (2) may contact you by push notification or text message to the phone number you supply to us. One agrees to promptly notify us if you change your phone number by updating your profile settings.
